PROPOSED COVENANT
Sheds, Shacks, Tents, Trailers and other movable, portable or temporary
structures
Covenant for Architectural Control, Article V, and Section 12, amended
(date goes here)
No shed, shack, trailer, tent or other temporary or movable building or
structure of any kind shall be erected or permitted to remain on any Lot with
the following exceptions:
- Sheds may be approved by the architectural control committee, assuming the
following conditions are met:
1. No shed may be taller than the property fence or be
visible from the street facing the front of the home.
2. Any shed that is approved must be maintained and kept
free of rust or rotting wood.
3. Current sheds that may have been improperly approved
by previous boards are hear-by "grand-fathered" in as of (date in
which the amendment is approved). Grand-fathered sheds MUST be removed
or brought into current board-approved compliance standards if the property
changes hands.
4. If an approved shed is not properly maintained the
board must inform the Lot owner in writing that the shed either needs to be
removed or brought into compliance. If an owner refuses to bring a
shed into compliance the board may have the shed removed at the homeowner's
expense.
- Understanding that some families may need to occasionally clean their
camping gear or wish to have a "campout" with their children on
their property, tents are permitted for a period not longer than two days
and one night.
- Temporary storage facilities, commonly known as "pods," may be
used for a period not longer than five days in an Owner's driveway with
board approval.
- Trailers or RVs of visitors may be parked in an Owner's driveway for no
longer than five days.
- Owners of trailers or RVs must keep them in the garage. Any trailer
or RV that will not fit in a garage must be stored outside of the Secret
Woods subdivision. Trailers or RVs may be parked temporarily in
an Owner's driveway for a period not longer than two-days before a trip and
two-days following a trip.
CURRENT COVENANT
No Sheds, Shacks or Trailers
Covenant for Architectural Control, Article V, and Section 12
No shed, shack, trailer, tent or other temporary or movable building or
structure of any kind shall be erected or permitted to remain on any Lot.
However, this paragraph shall not prevent the erection of a temporary office and
other buildings during the period of actual construction of the main residence
and other buildings permitted hereunder, nor the use of adequate sanitary toilet
facilities for workmen during the course of construction.
Likewise, any contractor or salesperson may maintain a trailer or portable
construction shack of attractive design on any Lot used in connection with
the construction or sale of houses being built in the subdivision for no longer
than thirty-six (36) months.
